WAYFAIR is the customer of the portal and is responsible for the textual content as well as the concrete pension provision offered to employees via this online service.
Legal position of Pension+Services GmbH
Pension+Services advises WAYFAIR (employer) and, on behalf of the employer, its employees in all matters of occupational pensions.
Pension+Services is a consulting company which is not affiliated with any pension providers or contractually obliged to broker or manage contracts for any pension providers or product suppliers. Even if Pension+Services acts as a broker of pension products in addition to providing purely advisory services, Pension+Services expressly represents only the interests of its customers (employers) and acts as their “trustee”. The interests of third parties, in particular insurance companies or similar, must not be considered. In this respect in particular, the status of Pension+Services differs from, for example, insurance agents or multiple agents who, according to the legal definition, must represent the interests of insurance companies.
For customers, Pension+Services makes recommendations on the basis of objective and balanced market research. With regard to occupational pensions, the employer always has the right to choose and determine pension providers. They do not have to follow the recommendations of Pension+Services. Pension+Services can also take over the management of existing pensions that are in place at the employer or are brought to the employer – a separate agreement is necessary for this.
Pension+Services only ever acts on the basis of a written order from the customer (employer). Our activities are described in full in each order. Under no circumstances can it be assumed that we will act above and beyond the activities described in the order; in particular we do not accept any permanent service mandate unless expressly specified in the order.
